  2. Names of A-I clients and brief descriptions of their cases
    1. Anonymous: anonymous clients represented in cases in JCP (New York State JUSTICE CENTER for the PROTECTION of People with Special Needs)
      1. Introduction 2022mar14 Lippes Mathias firm represented clients in cases handled by JCP. The JCP web site provides PDF files each of which pertains to one case. The PDF files expurgate much information (for example, the names of the government employees, where the events happened, and the case numbers). In the PDFs, the expurgated text is shown by a black region. Below, we use "XXX" where the PDF file has a black region. Because of extensive expurgation, we (this web site) don't know well the facts which led to these cases. Each PDF file has a short name.
      2. Coligan: Lippes attorney Sarah Michelle Colligan We know of one JCP case. Name of case's PDF file: 2017-057.pdf government attorney Robert DeCataldo, Esq. New York State Justice Center for the Protection of People with Special Needs 161 Delaware Avenue Delmar, New York 12054-1310 ALJ hears and recommends. Then, there is a decision. hearing 6 March 2017 JCP hearing at 9 Bond Street – 3rd Floor Brooklyn, New York 11201 (We guess that the accused employee lives or works in or near Brooklyn.) Keely D. Parr, ALJ recommended a decision. David Molik then decided on 20 March 2017. Decision: The request of XXX is granted. The Subject (the accused employee, the Lippes client) has not been shown by a preponderance of the evidence to have committed physical abuse. The Lippes client won.
      3. Hannigan: Lippes attorney Emily Grace Hannigan
        1. 2017 case 2017-055.pdf
          1. Intro We don't know the case number. Perhaps it is Justice Center case number 2017-055. The case is described in a PDF file which JCP seems to call 2017-055.pdf. Click the picture below to read that file.
a Levene lawyer and a Lippes lawyer
          2. Events before and during the 2017 case Events in 2017 ALJ Nasci recommended on 10 March. Director Malik decided on 20 March. prosecutor Thomas Parisi, Esq. New York State Justice Center for the Protection of People with Special Needs 161 Delaware Avenue Delmar, New York 12054-1310 There may have been a hearing at: New York State Office Building 44 Hawley Street, Room 1701 Binghamton, New York 13901. There seem to have been three defendants, all employees of NYS OPWDD. New York State Office for People With Developmental Disabilities The defendants are called "subjects." They were accused of category 2 neglect which supposedly caused brain injury to a woman in a wheelchair. Hannigan represented at least one one of the defendants. There may have been another defense lawyer. Elizabeth A. Sopinski, Esq. Levene Gouldin & Thompson, LLP P.O. Box F-1706 Binghamton, New York 13902 Binghamton is where the ALJ hearing seems to have been and where the Levene law firm seems to be. Sopinski may have represented at least one of the defendants. Was any defendant represented by both Sopinski and Hannigan? We guess that both attorneys represented all defendants. Who paid the Levene law firm? We guess that the Lippes firm paid. We think that none of the defendants were at the hearing handled by the ALJ. In the PDF file, Sopinski's name is higher than Hannigan's name. Why? Is that a coincidence? Was Hannigan at the hearing handled by the ALJ? It is difficult to understand the report because many facts seem to be blacked out, some crucial facts are not stated, and some, crucial facts are stated ambiguously.
          3. Outcome ofn2017 case All defendants won.
        2. 2019 Hannigan case, PDF file 2019-003.pdf 2023sep17 our main source PDF file 2019-003.pdf Todd M. Sardella, Esq. for Justice Center Emily Hannigan, Esq. for defendant "Subject" The hearing was in Poughkeepsie 12601. Brian T. Hughes, Administrative Hearings Unit, recommended a decision on December 18, 2018. Elizabeth M. Devane, ALJ, adopted his recommendation on January 4, 2019. . There were two allegations against the defendant. He won on the first but lost on the second.

      4. Schaefer: Lippes attorney Lawrence Henry Schaefer
        1. 2016-153.pdf The hearing seems to have been in Rochester: New York State Justice Center for the Protection of People with Special Needs 2165 Brighton Henrietta Town Line Road Rochester, New York 14623 Perhaps the accused employee ("Subject" of the case, client of Lippes) works or lives in or near Rochester. Nasci recommended a decision. Then Molik decided. Nasci recommended on 21 November 2016 in Schenectady, New York John T. Nasci, ALJ decision by David Molik Director of the Administrative Hearings Unit 29 November 2016 Schenectady, New York Decision The request of XXX, as it pertains to Allegation 2, is granted. The Subject has not been shown by a preponderance of the evidence to have committed neglect. The request of XXX, as it pertains to Allegation 3, is denied. The Subject has been shown by a preponderance of the evidence to have committed abuse (deliberate inappropriate use of restraints). The substantiated report is properly categorized, as a Category 3 act. Perhaps a poorly behaving female, 70 years old, living in a mental health treatment hospital, was deliberately, wrongly restrained by a registered nurse.. It seems to us (this web site) that the Schaefer client ("Subject," employee) won on an accusation of negligent misconduct ("granted") but lost on an accusation of deliberate misconduct ("denied").

CASE OUTCOME The client won.
          2. Background according to the PDF file The events occurred in a psychiatric treatment hospital that provides psychiatric treatment for inmates who are incarcerated in New York State correctional facilities. The Service Recipient was an adult male approximately sixty years old.

Sullivan seems to have defeated Schaefer. __________ The request of XXX that the report be amended and sealed, is denied. The Subject committed abuse (deliberate inappropriate use of restraints). The report is a Category 3 act. recommended by Elizabeth M. Devane, Administrative Hearings Unit. October 20, 2020 Schenectady, New York
          2. Our comment On 20 October 2020, Devane recommended. On 9 November 2020, Devane decided that the recommendation be adopted. The same person recommended and later decided that the recommendation be adopted. As far as we know, JCP usually has one person recommend and a different person decide whether the recommendation should be adopted. What is the value of the same person recommending and later deiding whether to adopt the recommendation? October sinature of Elizabeth M. Devane as recommender Do we misunderstand how Justice Center handled the case? Is this PDF file a hoax?

    4. Cerrone: THOMAS C. CERRONE 2023sep16
      1. Litigation
        1. Introduction We are not certain what happened. In this article about Cerrone, we state what we think happened. We might be wrong. There was a hit-and-run incident in 1993. Later, investigators suspected a cover-up. Cerrone was a cop for the NY State Police. As part of the investigation of the suspected cover-up of the 1993 incident, some of his fellow cops questioned him in 1995. As far as we know, he later complained that his colleagues, without probable cause, arrested him, then questioned him in a hotel for six hours. As far as we know, his colleagues said that there was no arrest, that he was free to leave and knew it, and that he voluntarily cooperated with them. He sued several cops in federal, trial court (NYND). As far as we know, that was the first court case. (Why was the first case in federal court, not state court? Was there a case in state court?) Later, some defendants appealed to a federal, appeal court (the Second Circuit's). Cerrone was the plaintiff in NYND and the appellee in appeal court. The appeal ccourt decided the appeal in April 2001. The legal dispute returned to the NYND case. NYND decided the case in September 2001. When the NYNDcase was finally decided in September 2001, only three of the original defendants were affected by that decision. In September 2001, the three, remaining defendants won. In 2008, Cerrone retired from the State Police as a sergeant. Attorney Lawrence H. Schaefer represented Cerrone when Schaefer worked for Hinman Straub firm. This was before Schaefer worked for Sheehan Greene firm. Who paid the Hinman firm for representing Cerrone? We think that a state police union paid. If a state police union paid, we guess that it was POLICE BENEVOLENT ASSOCIATION NEW YORK STATE TROOPERS, INC.. We think that there were only two court cases: a trial court case and an appeal court case, both in federal courts. We are not certain that all of this Cerrone article is right. This entire series of events would make a good movie.
        2. Federal appeal appeal decided 10 April 2001 United States Court of Appeals, Second Circuit short name of appeal case Thomas C. CERRONE, Plaintiff-Appellee, v. Scott L. BROWN et al., Defendat-Appellants __________ appeal court docket # 00-7177 case reporter 246 F.3d 194 (2d Cir. 2001) __________ Attorneys in the appeal courtroom Lawrence H. Schaefer, then of Hinman Straub, was for Cerrone. Alan S. Kaufman, of Chamberlain Kaufman, was for the appellants. Why didn't the AG rerpresent the defendant-appellants? Was there a conflict of interest`
        3. federal, trial court case in NYND THOMAS C. CERRONE, Plaintiff, -against- Michael F. Cahill et al. Defendants United States District Court, ND New York No. 95-CV-241 (NDNY, decided 28 Sep 2001) We think that this is the case which generated the appeal, the case which resumed after the appeal. __________ McAvoy, D.J. Plaintiff Thomas Cerrone ("Cerrone"), a New York State Trooper, commenced the instant action asserting claims pursuant to 42 U.S.C. § 1983 as well as state law claims for false arrest, false imprisonment, and intentional infliction of emotional distress. Cerrone's claims arise out of Defendants' investigation ... III. CONCLUSION Based upon the above, Defendants' motion for summary judgment is in all respects GRANTED and all claims against Michael F. Cahill, Salvatore S. Valvo, and Richard G. Morse are hereby DISMISSED WITH PREJUDICE. The Clerk of the Court is directed to enter judgment for the defendants and to close the case. IT IS SO ORDERED. __________

      1. Introduction to a court case involving a state government C.O. 2022mar23 NYS C.O. Timothy Cowen was injured. He worked at Mohawk Correctional Facility, in Rome, NY. His claim was arbitrated. He won in arbitration. There was a dispute in court about whether to confirm the arbitrator's award. In 2013, he won in court. DOCCS lost. Schaefer, of the Sheehan firm, won.
