The contract's name is "SECURITY SERVICES UNIT 2016-2023 AGREEMENT BETWEEN THE STATE OF NEW YORK AND NEW YORK STATE CORRECTIONAL OFFICERS AND POLICE BENEVOLENT ASSOCIATION, INC." Punishing an officer during a court case 2023nov13 When there is a court case against DoCCS because of a DoCCS officer's supposed mistreatment of a prisoner, winning the court case is more important to the AG's attroneys and to DoCCS than punishing the officer. There is no attempt to punish the officer until after the case ends. Most cases end long after the supposed mistreatment. The OER-NYSCOPBA contract forbids starting disciplinary proceedings long after supposed mistreatment. Therefore, some, guilty, DoCCS officers escape punishment. We wrote the opinion above under the influence of Amanda Fries's quotation from an email messsage from attorney Elizabeth Koob. The quotation is in an article, "Prison staff remain on payrolls despite excessive force lawsuits." The article, which is by Amanda Fries, was published by Poughkeepsie Journal on 30 September 2015.

      1. DoS and IRS According to the NYS DoS, which created the corporation, NYSCOPBA's name is "NEW YORK STATE CORRECTIONAL OFFICERS AND POLICE BENEVOLENT ASSOCIATION, INC." "And" is part of the name, not "&." The union often states its name with "&" instead of "and." For example, union treasurers used "&" in IRS form 990 about years 2016-2020: treasurer David Viddivo (2016), treasurer Toby Hogan (2017), and treasurer Frank Gilbo (2018-2020). The tax preparer of the forms 990 about 2016-2020 was Brian G. Leyden CPA, 7 AIRPORT PARK BLVD, LATHAM, NY 12110. At the bottom of the forms 990 about years 2016-2020, the following sentence appears: "THE FORM 990 TAX RETURN IS REVIEWD [sic] AT AN EXECUTIVE BOARD MEETING BEFORE FILING."
