A litigator has a duty to investigate whether a judge should recuse and also may investigate as part of judge-shopping. Part of the investigation should concern debts, income, and property of the judge and the judge's spouse. Voters may want to know about the debts, income, and property of judicial candidates.
  2. In New York City, non-federal judges run for election. The NYC BoE (Board of Elections) makes PDF files with the names and home addresses of judicial candidates. The files are distributed at the BoE's Web site. These are government publications available to the entire world through the World Wide Web. At our Web site, we have a page with links to these files. Thus, it's usually easy for visitors to our Web site to get the home address of a New York City, non-Federal judge. Non-Federal judgeships in New York City normally are sold. This housing information may be useful to people studying bribery. Often, an investigation of crime is helped by knowing where the criminals live.

We are under the impression that some of those Web sites provide copies of documents in that sealed case. Perhaps someone possibly violated, or is now is violating, the sealing order.

    In 1998, Bronx voters elected her to be a Supreme Court judge after she was cross-endorsed. Cross endorsement is a felonious scheme, common in New York, by which political parties endorse each other's judicial candidates to rig election outcomes. It is common for would-be candidates to pay a bribe to a political party in conjunction with a cross-endorsement. The Democratic, Republican, and Liberal parties all endorsed the same candidate (Mills), which is probable cause in New York state.

    Notice that, in some judicial general elections, a person is simultaneously a Republican candidate and a Democratic candidate. In other words, a voter in a general election may vote for a judicial candidate either as a Republican candidate or as a Democratic candidate. For example, in the November 2001 general election for supreme court judge, Myriam J. Altman (333 East 23 Street, NY NY 10010) seems to have been nominated by both the Republican and Democratic parties. Also, in the November 2003 general election for civil court judge, district 3 in Queens, Anna Culley (our impression of what her name then was) running as "Anna Seminerio-Culley" (219-46 93 Avenue, Queens NY 11428) seems to have been nominated by both the Republican and Democratic parties. Is cross-endorsement probable cause to arrest? (Incidentally, Anna Culley is the daughter of Queens Democratic state legislator Anthony S. Seminerio, discussed elsewhere in this website.)

    As far as we know, the usual procedure for purchasing a judgeship is to find out how much to pay as a bribe for that judgeship (normally in Queens, three times the annual salary, rounded off), then pay. Payment is often thinly disguised as contributions and as purchases of meals at fund-raising dinners. Payment is usually made to a county committee of only one political party but both parties in that county will nominate the payor for the judgeship he wants, thus assuring the payor that he will win the general election.

    Some people buy a cross-endorsement, then campaign for election. Other people buy a judgeship from the government. They pay to have a government executive nominate, and a legislative body consent, to the payor being a judge, as far as we know. Three fourths of the judeships will be sold to the political party of the executive, and one fourth to the other, major party, as far as we know. This arrangement allows each party to get judicial bribe income even when it does not control the executive branch.

    These topics, which do not necessarily apply to anyone named in this website, may possibly pertain to grounds for recusal for cause.

    To understand the judgeship-selling business, one must know whom the judge contributed to before he was nominated, which is almost always far more important than who contributed to his campaign.

    New York City voters in general elections often do not notice that the same person is both the Democratic and the Republican candidate for the same judgeship. (By the way, this is useful for scholars trying to measure the relative power of parties in a neighborhood, because scholars can count how many votes a judicial candidate gets as a Republcian, as a Democrat, etc., in the same election.)

    When newspapers, websites, and voters' guides describe and endorse candidates in general elections in New York, judicial candidates often are not even mentioned. It can be extremely difficult for an ordinary person in New York City to find out the names of judicial candidates except directly from the election board (much less, to find out reasons why one candidate is better than another). For ordinary people, it is impossible to find out which judicial candidate in a New York city general election is better at jury trials, divorce trials, appeals, understanding scientific evidence, or managing a courtroom. If a judge is running for re-election in a general election, it is usually impossible for ordinary people to find out the per centage of his cases that are upset on appeal, the recidivism rate of people he sentences, how many hours a week he's in the courthouse, and how lawyers (not carefully selected officials of lawyers' associations) evaluate him as a judge. If a non-judge is running for judge in a general election, it is impossible for ordinary people in New York city to find out how many jury trials or appeals he has had (much less: what per cent he has won compared to other lawyers doing his kind of work). In any judiicial general election, it is usually impossible for ordinary people to find out which candidate is smarter and politer than his opponent. Most lawyers' associations either do not evaluate judicial candidates or do not give the public lists of candidates' names and the evaluations given to those candidates. Knowledge is power. In judicial general elections in New York City, voters are amazingly ignorant. What criteria should voters use in voting for judges in New York City, keeping in mind that there is an embargo on information that most reasonable people would want to know before voting?
