  1. Two judges, two counties

    Most trial court judges live in the county in which they work. Elaine Rushing works in Sonoma county (in Santa Rosa city 95403), which is north of San Francisco Bay, but seems, according to state political contribution records, to have lived in San Jose 95125 (Santa Clara county), which is south of the bay. That's a long commute.

    Conrad Lee "Connie" Rushing is an appellate judge in California's 6th appelate district, working in San Jose 95113. He became a California lawyer in 1964. He seems to live in Sonoma county: CONRAD L RUSHING, 3452 SELENE CT, SANTA ROSA, Sonoma county, CA 95404-1643. That's a long commute.

    In summary, public records seem to indicate that Elaine works near Conrad's Santa Rosa home, Conrad works near Elaine's San Jose address, and therefore they both have a long commute. They are married to each other. It seems unlikely that Elaine and Conrad live in different counties. Maybe some of their address information in public records is wrong. Her San Jose address (shown on her political contribution records) seems to have been supplied by her.

  2. Hit and run

    In early 2006, she had a Porsche and was about 57.

    According to the 3 February 2006 NOTICE OF FORMAL PROCEEDINGS in INQUIRY CONCERNING JUDGE ELAINE M. RUSHING, NO. 177 of CJP (THE California state government's COMMISSION ON JUDICIAL PERFORMANCE), she's done (according to former URL 216.109.125.130/search/cache?p=%22Commission+on+Judicial+Performance%22+elaine+rushing&fr=yfp-t-501&toggle=1&ei=UTF-8&u=www.cjp.ca.gov/Notice%2520of%2520FP/Rushing%25202-3-06.pdf&w=%22commission+on+judicial+performance%22+elaine+rushing&d=PEHU1JIFNlph&icp=1&.intl=us) some crimes while a judge (for example: criminally trying to use her judgeship and her husband's judgeship to avoid and abort her arrest, hit and run driving, drunk driving). For her crimes (described more in the CJP notice linked to above), some people might be convicted of a felony or at least have to live in jail for a while. We suppose that she was not required to live in jail to serve her sentence. By the way, in her hit and run incident, she told a police officer (who saw the car that hit and ran) that she had not driven the car, that she had been in the back seat. The car did not have a back seat, according to the CJP notice.

    There was a recent, New Jersey attorney general who wrongly protected her boyfriend from a ticket or two and impoundment of his car. For that, she was forced to resign as state attoirney general. Although Elaine's crimes and remarks were far worse, California's CJP decided merely to slap her wrist. She's still working as a judge.

  3. Her previous name

    Once she was Elaine Watters, possibly her previous, married name.

Driving distance between the Cannes and Bent Tree addresses is about 1.19 miles, which might take about 4 minutes o drive.

  5. Comments

    Above are described two Sonoma county parcels: a parcel which may be owned by Conrad, and a different parcel which may be owned by Elaine. The owner of each parcel claims to live on his parcel. Usually in northern California, a husband and wife live on the same parcel.

    Elaine is a judge for Sonoma county. Conrad is a judge for the 6th appellate district. Sonoma county is not in the 6th district. In some places in America, judges are required to live in their district, at least on election day, as far as we know. If the judges Rushing live together (or even in the same county), one of them is not living in his district.

    Elaine was appointed judge by a Democrtic governor, Davis. She contributed to Wes Chesebro, a Democrat who is the state senator who represents Santa Rosa. She seems to have claimed, in conjunction with her contribution, to have an address in San Jose 95125. We don't know what that full address, just San Jose 95125. We don't know if a San Jose resident is permitted to be a Sonoma county Superior Court judge. We guess that it's illegal to provide false information (for example, a false address) in conjunction with a political contribution. She provided that address for a few contributions shown on this page; for example: RUSHING ELAINE, US [sic] SUPERIOR COURT, JUDGE, SAN JOSE, CA 95125 (a 2004 contribution). By the way, despite her seeming claim in 2004, she never worked for "US SUPERIOR COURT". She worked for the California Superior Court.

  6. She will not be prosecuted for trying to get special treatment as a judge. We don't know if she did any campaign finance crimes. When considering Elaine's conduct, it's imporatant to do more than ask what crimes she did. Alcohol reduces inhibition; for example, alcohol loosens the tongue. When people are drunk, they reveal their inner selves. They do what they want and say what they think. When one considers what she said and how she talked, one realizes that she lacks the character that a judge should have. She got the treatment that Mel Gibson wishes he had gotten. The prosecutor and judge(s) in her case don't seem to have thought that her drunken statements reveal her true belief (namely, that a police officer should illegally do a favor for her because she and her husband are judges). Someone with her belief, someone who tries to undo arrest by getting a special favor because she's a judge, should not be a judge.

    For the first few years she was a Sonoma county Superior Court judge, suppasedly she mostly did criminal cases. Then, supposedly she was given civil cases. Maybe low-seniority judges there must do criminal work. We don't know what her legal specialty was before she became a judge. When she was a presiding judge, she was described as hard on crime.

    Because she was a judge (and had been a presiding judge) in Sonoma county while being prosecuted, a non-Sonoma judge should have presided over her case. We do not know if one did.

    No refund is paid when a California judge is removed from the judiciary. This policy may possibly have encourged a compassionate desire to let her remain a judge.
